New consumer credit law

The Office of Fair Trading has published a series of frequently asked questions for businesses that advertise credit services.  The FAQs cover how to comply with new credit advertising rules that came into force on 31 October under amendments to the Consumer Credit Act 1974, namely the Consumer Credit (Advertisements) Regulations 2004.  The new rules relate to such issues as the way terms and conditions are explained in credit advertisements.

These regulations place specific obligations on businesses using the web to promote credit services to display certain information, such as terms and conditions of lending, prominently and on a single web page, and to avoid the use of pop-ups and banners to provide important details.
